We’re very fortunate to have both the National Grocers Association  (NGA) and the Food Marketing Institute (FMI)  ready to represent the US grocers positions with the proposed rules by the US Food and Drug Administration (FDA) that will require grocery stores, as well as restaurants,convenience stores and vending machines with 20 or more locations to list calorie information on menus and on menu boards.

Don’t take a “sigh of relief” because you don’t operate 20 or more stores.  It may be inevitable that the requirement may take a new course in the future and impact every grocer. Having digital menu boards allows you to quickly, easily and affordably meet future FDA requirements.

The Affordable Care Act – FDA’s Final Rules

The March 2010 passage of the Affordable Care Act included the menu labeling law which will require restaurant chains with 20 or more locations operating under the same brand to provide detailed nutrition information to guests and show calories on the menu, menu board or drive through menu board.

However, the FDA’s final rules will include grocery stores.

Peter Larkin, CEO of the NGA is determined to press Congress for bipartisan legislation to address what he has called “regulatory overreach.”  Hopefully the NGA will be successful in these efforts but you may want to think about “going digital” now to prepare for an uncertain future.

These new rules will take effect in one year. 

So, the choice is yours.  Let’s hope that including nutritional information will be excluded from grocery stores, or take the initiative to be prepared for the “mad rush” in the event there isn’t a political solution arrived at to exclude grocery stores.
